    1. About these Terms

    These Terms of Use ("Terms") apply to your use of the public DWEL marketing website at dwel.digital (the "Site"), operated by DWEL, Inc. ("DWEL," "we," "us," or "our"). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

    2. The Site is informational only

    The Site exists to describe DWEL’s elder care benefit, share research, and let you contact us or request a demo. It does not provide care coordination, voice check-ins, scheduling, transportation, shopping, calendars, or any other DWEL product feature. Access to those features is provided through the separate, login-protected DWEL application and is not granted by these Terms.

    3. Demos, screenshots, and forward-looking content

    Product screenshots, mockups, videos, illustrative workflows, statistics, and forward-looking statements on the Site are provided to help you understand what DWEL offers. Actual product features, content, pricing, availability, and behavior may differ and may change without notice. Nothing on the Site is a commitment to deliver any specific feature on any specific date.

    4. The DWEL application is governed separately

    Use of the DWEL application by an employer, broker, partner, caregiver, or care recipient is governed by the customer agreement, order form, end-user terms, and in-product privacy disclosures presented to that party at the time of access. Those documents control over these Terms with respect to use of the DWEL application.

    5. Acceptable use

    When you use the Site, you agree not to:

    • Submit false, misleading, or fraudulent information through the contact or demo forms.
    • Use the Site or its forms to send spam, malware, or unlawful content.
    • Attempt to access non-public areas, scrape the Site at a rate that disrupts service, or interfere with its security.
    • Reverse engineer, copy, frame, mirror, or republish the Site or its content except for ordinary browsing.
    • Use the Site in any way that violates applicable law or the rights of others.

    6. No medical care, no emergency response

    DWEL does not provide medical, nursing, or clinical care, and the Site is not a substitute for professional medical advice, diagnosis, or treatment. Nothing on the Site, including any AI-generated explanation, is medical advice. The Site is not monitored for emergencies and cannot be used to summon help. In a medical or safety emergency, call 911 (or your local emergency number) immediately.

    7. Third-party links and embedded content

    The Site links to and embeds content from third-party services (for example, the YouTube video on the How It Works page and the LinkedIn and YouTube channels linked in the footer). We do not control those services and are not responsible for their content, terms, or privacy practices. Your use of those services is subject to their own terms.

    8. Intellectual property

    The Site and its content — including text, graphics, illustrations, video, the DWEL name and logo, and the design of the Site — are owned by DWEL or our licensors and are protected by copyright, trademark, and other laws. You may view and share links to the Site for personal, non-commercial purposes; all other rights are reserved. We welcome press inquiries; please email us before reproducing logos or significant excerpts of the Site.

    9. Disclaimer of warranties

    THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is current or complete.

    10. Limitation of liability

    To the maximum extent permitted by law, DWEL and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or business interruption, arising from or relating to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability arising from or relating to the Site is limited to one hundred U.S. dollars (US$100).

    11. Indemnification

    You agree to defend, indemnify, and hold harmless DWEL from and against any claims, damages, liabilities, and reasonable expenses (including attorneys’ fees) arising out of or relating to your misuse of the Site or your violation of these Terms.

    12. Governing law and changes to these Terms

    These Terms are governed by the laws of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Collier County, Florida, and you consent to the personal jurisdiction of those courts. We may update these Terms from time to time. The current version is always posted at this URL with a “Last updated” date. Your continued use of the Site after the date of an update means you accept the updated Terms.
